We assist large and small banking and financial institutions with the numerous and diverse legal issues that they face, with a focus on commercial lending. We provide legal services covering a broad range of commercial lending issues, from initial loan documentation and collateralization through receivership, judicial and non-judicial foreclosure, and collateral recovery and debt collection when necessary. We further provide loan resolution services, including negotiating with borrowers and devising and documenting troubled debt restructures and work-out plans. We also advise and represent our banking and financial institution clients in connection with transactions and disputes with other institutions, including those that involve loan participation agreements. As the situation requires, we represent our banking and financial institutions in enforcement actions and in a wide range of other types of litigation in state and federal courts (including bankruptcy courts), as well as in mediation and arbitration proceedings.

In addition to the transaction specific needs of our banking and financial institution clients, we also offer certain on-going preventative services. For example, in an effort to assist our banking and financial services clients in avoiding sometimes simple, but potentially costly commercial loan mistakes that affect enforcement, we provide on-site seminars and training as needed regarding loan documentation, collateralization, and priority requirements. Similarly, we offer our banking and financial institution clients commercial loan file spot-check reviews, which help to identify areas of possible improvement and which sometime result in the ability to correct transaction specific problems in advance of any enforcement needs.
