Diane Baker

Shareholder

Diane’s practice is focused on Wills, Trusts, Estate Planning and Probate. She enjoys working with families and individuals to develop personalized Wills and estate plans, based on each client’s goals and objectives. A particular focus of her practice is estate tax planning for high net worth families, including family business owners.

When a family has suffered the loss of a loved one, she helps them through the complexities of Probate, and the challenges of Will contests and estate disputes. She regularly handles Probate cases in Fulton County, DeKalb County, Cobb County, Forsyth County, Gwinnett County and other counties in the metro Atlanta area. She is also experienced with Probate cases in many other counties throughout Georgia.

Diane also handles Guardianship and Conservatorship cases, providing the legal authority to handle the affairs of someone who is incapacitated due to an illness or accident. These issues are being faced by more and more families today, and, unfortunately, can often involve family disputes.

She also prepares Pre Nuptial (Pre Nup) agreements, and advises clients on the estate planning issues involved in marriage or remarriage.

Her goal is to address each client’s personal objectives, while making the legal process understandable.

Diane began her legal career with the Atlanta firm of Hansell & Post, where she practiced primarily in the Banking and Finance section of the firm, as well as handling general corporate law matters.

Later, she served as Senior Counsel for NationsBank, a predecessor firm to Bank of America. During her years at the bank, her work included regulatory and deposit matters, as well as management of general legal matters for the branch network in the State of Georgia. She also managed retirement product legal matters nationwide.

After leaving the Bank, Diane and her husband established and managed a small start-up software company in the 1990s. This experience provided her with invaluable insight into the challenges faced by family business owners.

Diane received her undergraduate degree, summa cum laude, from Oglethorpe University, and her law degree, with distinction, from Emory University’s School of Law.

She has been rated “AV Preeminent” by the peer review rating system of Martindale-Hubbell Law Directory (its highest rating) for over 20 years.

She is active in community and professional organizations, having served as President of the Oglethorpe University National Alumni Association, and as a Trustee of the University. She currently serves on the President’s Advisory Council of Oglethorpe University.

She is honored to have served as President of the Estate Planning Council of North Georgia, and is also a member of the Atlanta Estate Planning Council. She is the former Chair of the Georgia ElderCare Symposium, which has grown into the national ElderCare Matters Alliance.

Diane is a frequent speaker at financial and estate planning seminars, and truly enjoys meeting clients and helping them develop well designed estate plans that help to avoid federal estate tax.
